This website is operated by Genkem (Pty) Ltd (“we”, “us”, “our”). Our website address is https://genkem.co.za.

We are the responsible party for the personal information processed through this website, as defined in the Protection of Personal Information Act 4 of 2013 (POPIA).

What personal information we collect and why

We collect personal information so that we can sell products, fulfil orders and run this website. Depending on how you use the site, this may include:

  • When you place an order: your name, billing and delivery address, email address, contact number, order details and the payment information needed to process your purchase.
  • When you create an account: the details you enter into your user profile.
  • When you contact us or leave a comment: the details you submit, along with your IP address and browser user agent string for spam detection.
  • Automatically as you browse: cookie and usage data, as described under Cookies below.

We use this information to process and deliver orders, manage your account, respond to enquiries, prevent fraud and spam, comply with our legal obligations and, where you have agreed, send you marketing.

Our lawful basis for processing

We process your personal information on one or more of the following bases under section 11 of POPIA: to perform our contract with you when you place an order, to comply with a legal obligation, for our legitimate business interests, and on the basis of your consent where consent is required.

Cookies

If you leave a comment on our site you may opt in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies last for one year.

If you visit our login page, we set a temporary cookie to determine whether your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

When you log in, we also set up several cookies to save your login information and your screen display choices. Login cookies last for two days and screen options cookies last for a year. If you select “Remember Me”, your login will persist for two weeks. If you log out of your account, the login cookies will be removed.

If you edit or publish an article, an additional cookie is saved in your browser. This cookie includes no personal data and simply indicates the post ID of the article you just edited. It expires after one day.

We also use analytics and advertising cookies from third-party providers to understand how visitors use the site and to measure the performance of our marketing. You can manage non-essential cookies through your browser settings.

Comments

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymised string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available at https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

Embedded content from other websites

Articles on this site may include embedded content (for example videos, images or articles). Embedded content from other websites behaves in the exact same way as if the visitor had visited the other website. These websites may collect data about you, use cookies, embed additional third-party tracking and monitor your interaction with that embedded content.

Who we share your data with

We share personal information with third parties only where necessary to run the website and fulfil your orders. These operators process data on our behalf under appropriate safeguards and include our payment processor, our courier and delivery partners, our website hosting provider, our email and marketing platform and automated spam detection services.

If you request a password reset, your IP address will be included in the reset email.

Cross-border transfers

Some of these services, including Gravatar, which is operated by Automattic, may process your information outside South Africa. Where this happens we take reasonable steps to ensure your information is protected to a standard comparable to POPIA, as required by section 72.

How long we retain your data

If you leave a comment, the comment and its metadata are retained indefinitely so that we can recognise and approve follow-up comments automatically. For users who register, we store the personal information they provide in their user profile. Order records are kept for as long as we are required to hold them for tax, accounting and legal purposes. We do not keep personal information for longer than is necessary.

How we keep your data secure

We maintain reasonable technical and organisational measures to protect personal information against loss, unauthorised access and misuse, in line with section 19 of POPIA.

Your rights

Under POPIA you have the right to:

  • Request access to the personal information we hold about you.
  • Request that we correct or delete your personal information.
  • Object to the processing of your personal information in certain circumstances.
  • Withdraw consent where we rely on it, without affecting processing already carried out.
  • Lodge a complaint with the Information Regulator.
